General terms and conditions of sale
Our guest rooms comply with the provisions of articles D. 324-13 and D. 324-14 of the French Tourism Code. The purpose of these terms and conditions is to inform you about the terms and conditions of accommodation, reservations and cancellations, as well as our respective responsibilities. They govern the booking contract between you, the customer, and us, Le Machaon:
by means of our commercial website: www.lemachaon.fr
or by e-mail to contact@lemachaon.fr
or by post to ‘Le Machaon - 3 rue Jean-Henri Fabre - 12780 Saint Léons’.
These GTC are subject to change at any time without notice.
Article 1 - Length of stay
The customer who signs this contract for a fixed period may not under any circumstances claim any right to remain in the premises.
Article 2 - Conclusion of the contract
All bookings will only become effective once a deposit of at least 30% of the total cost of the holiday or the full cost of the holiday has been received. Payment of this deposit or of the total cost of the holiday implies acceptance of these general terms and conditions of sale and of the prices.
This confirmation constitutes acceptance of these general terms and conditions of sale and rates.
Under no circumstances may the rental agreed between the parties to this contract be made available, even partially, to third parties, whether natural persons or legal entities, without the written agreement of the owner.
Any infringement of this last paragraph may result in the immediate cancellation of the rental to the detriment of the Hirer, with the proceeds of the rental remaining the definitive property of the Owner.
Article 3 - Modification
Any change to a reservation must be requested directly from our guest house, either by post or by e-mail, as indicated in the preamble to these conditions.
Article 4 - No right of withdrawal
For bookings made by post, telephone or internet, the tenant does not benefit from the withdrawal period, in accordance with article L121-21-8 of the French Consumer Code, relating in particular to accommodation services provided on a specific date or at a specific time.
Article 5 - Cancellation by the customer
All cancellations must be made directly to our guest house, either by post or by e-mail to the addresses given in the preamble to these conditions (the date and time of receipt of the e-mail or the date and time of issue of the postcard being taken as proof).
In the event of cancellation more than 7 days before the planned date of arrival, we will refund the deposit received.
In the event of cancellation less than 7 days before the date of arrival, the deposit of 30% of the total amount of the stay or, where applicable, if the total amount of the stay has already been paid, 30% of the total amount will be retained, with the remainder being returned.
If the customer does not show up before 8 pm on the day scheduled for the start of the stay without having given prior notice, this contract becomes null and void. The owner will then be able to use his guest rooms.
The deposit paid or 30% of the total amount in the case of full payment of the stay shall be retained by the owner, who shall be entitled to claim and invoice the balance of the price of the stay (in accordance with the booking contract) if the stay remains vacant following cancellation.
In the event of delayed arrival and/or early departure during the stay: full payment for the service booked is due for whatever reason.
Article 6 - Cancellation by the owner
If, before the start of the stay, the owners cancel the stay for reasons beyond their control, they must inform the customer as soon as possible by telephone or e-mail. The amount paid will be reimbursed immediately.
Article 7 - Arrival time
Arrival is expected in the afternoon from 5 pm, and is possible until 7 pm. If you have any special or unforeseen requests, please contact us to let us know about any delays.
Article 8 - Departure time
Rooms must be vacated by 10:30 am at the latest.
Article 9 - Payment of the balance for accommodation
The balance of your stay must be paid on the day of your departure, in accordance with your booking contract, plus any additional costs, including those for the table d'hôtes and drinks.
Article 10 - Changing rooms
Without the customer being able to claim any compensation, the owner reserves the right to change the room initially booked by the customer for a room of the same or greater capacity. In this case, the cost of the reservation remains unchanged.
Article 11 - Pets
We accept one pet per room. Only cats and dogs up to 20 kg are allowed with their blanket, cage or kit. Birds, reptiles or any other animal are strictly forbidden.
There will never be more than one room rented with a pet on the same dates of stay, for obvious reasons of potential incompatibility between pets of different owners.
If, on the day of arrival, the customer arrives accompanied by one or more unannounced pets, the refusal to accept the pets and their owners in the guest house Le Machaon cannot be considered as a modification or breach of contract on the initiative of the owner of the guest house. Consequently, in the event of the guest's departure, no reimbursement can be considered.
The owner of the animal must keep it in appropriate hygienic and sanitary conditions.
The owner is responsible for any damage caused by his or her pet, whether to people or furniture. A deposit in the form of a cheque for 200€ (Dogs) / 400€ (Cats) is required on the day of arrival, but if the damage caused during your stay exceeds this amount, you undertake, as a guest of Le Machaon guest house, to reimburse the damage in full, if necessary by taking out civil liability cover under your personal, home or other insurance.
La maison d'hôtes Le Machaon reserves the right not to accept a pet that disturbs other guests or behaves inappropriately during the stay (e.g. barking regularly). Guests must be responsible for their pets and their behaviour at all times. Refusal to accept an animal with inappropriate behaviour in Le Machaon guest house cannot be considered as a modification or breach of contract on the initiative of the guest house owner. Consequently, in the event of the guest's departure, no refund can be envisaged.
Dogs of breeds considered to be PPP are not admitted to Le Machaon guest house.
Any animal accepted in one of the rooms of Le Machaon guest house must under no circumstances and at no time remain alone and locked up in the room in the absence of its owners, unless an exception has been discussed with the owner prior to booking and provided that the animal does not cause any inconvenience to the other guests of the guest house or to its owner. The animal must therefore remain calm in the absence of its owners (e.g. no crying or barking), respect the peace and quiet of the premises and not damage the furniture in the room.
Pets must not climb on beds, armchairs or other furniture in the room.
Dogs must be kept on a lead on the property.
Pet owners are responsible for keeping their pets clean and for cleaning up after their pets in and around Le Machaon guest house.
It is strictly forbidden to wash pets in the room's shower and to use the guest house's towels to dry them.
Article 12 - Lifestyle and use of the premises
To ensure the tranquillity of the premises and the comfort of guests, a certain ‘art de vivre’ is required of everyone. In particular, guests are asked not to smoke indoors. The customer undertakes to comply with the etiquette instructions provided and with these general terms and conditions of sale.
The customer undertakes to return the rooms in perfect condition and free of damage at the end of the stay and to systematically declare - and assume financially - any damage for which he/she is responsible. The cost of repairs, including the time required to restore the property to its original state, will be invoiced separately and paid for on the basis of receipts for the costs incurred.
Please note that the kitchen in the guest house is not freely available to guests.
Guests' attention is drawn to the fact that minors on the property are the sole responsibility of their parents or guardians. Children must always be accompanied by an adult in our house and/or on the grounds.
Your stay at Le Machaon and use of our equipment and facilities is voluntary and at your own risk.
Le Machaon is not responsible for loss, theft and/or damage or injury to property and/or persons on the property, however caused.
Article 13 - Modification of the conditions of sale
These terms and conditions of sale may be amended at any time without notice. Acceptance of and compliance with these terms and conditions of sale are deemed to have been accepted as soon as the deposit has been paid.
Article 14 - Data Protection Act
In accordance with the French Data Protection Act no. 78-17 of 6 January 1978, you have the right to access and correct your personal data. Under no circumstances will we pass on the information you provide to other companies or organisations.
